With more than twenty-five years of experience, Mr. Volmert represents clients in many different industries regarding environmental permitting, compliance and enforcement. Since joining Holland & Hart in 1990, he has worked with clients in the oil and gas, mining, energy and traditional manufacturing industries, as well as firms with a technological focus. He helps these clients negotiate permits, resolve disputes, obtain favorable agency rulings and defend enforcement proceedings, and advocates for them in court when necessary. His practice focuses mainly on air quality and climate change, but he also represents clients regarding water quality, hazardous waste and NEPA.
He has participated in cutting edge issues in air quality regulation and enforcement, helping clients avoid plant shutdowns, minimize penalties, and reduce permitting burdens. He participated in the case of Alaska v. EPA decided by the U.S. Supreme Court in 2004; represented an electric power generator regarding nationally significant air quality issues in National Parks; advocated for the oil and gas industry regarding regulation of "flash" emissions at production sites; worked on ozone rules for the Denver Metropolitan area; has successfully appealed a Title V operating permit for a refinery; co-authored recent briefs regarding national particulate matter standards; and is working on mercury control requirements for coal plants and gold mines and on continuing air quality challenges to coal-fired power plants. Mr. Volmert currently represents oil and gas companies concerning ozone and other air quality challenges to ongoing development, and is involved in the ongoing development of regional haze rules.
Recent work on climate change issues includes defending a permit for a coal-fired power plant against claims that it should have regulated greenhouse gas emissions and required coal gasification; assisting a client with permitting issues concerning a commercial scale demonstration project for CO2 capture; advising clients regarding consideration of climate change issues in Environmental Impact Statements; speaking at seminars regarding coal plant development and climate change; and coordinating and speaking at Holland & Hart's 2008 annual climate change seminar on the topic of carbon capture and sequestration.
Before joining Holland & Hart, Mr. Volmert was Associate General Counsel and environmental counsel for the Alyeska Pipeline Service Company from 1981-1990. In that capacity, he successfully represented Alyeska in major enforcement actions and complex permit negotiations regarding air and water quality matters. These included a high-profile EPA investigation of alleged fraud and violations of the Clean Water Act, and a major State/EPA Clean Air Act enforcement action. He was responsible for developing the company's hazardous waste compliance and environmental audit programs, as well as participating in enhanced oil spill response planning after the Exxon Valdez spill.
PROFESSIONAL ACTIVITIES Mr. Volmert has been selected by his peers as a Colorado Super Lawyer in the Environmental Law specialty. He is active with the Air Quality Committee of the Colorado Association of Commerce and Industry, the Colorado Petroleum Association, and the Colorado Oil and Gas Association, assisting these industry groups concerning developing issues. He is a member of the Environmental Section of the Colorado Bar Association and serves on the Denver Bar Association Fee Arbitration Committee.
He co-authored the Air Quality and Water Quality Chapters of "Environmental Regulation," excerpted from the "Second Edition of the American Law of Mining," Matthew Bender & Company, Inc. (2003), and has spoken on air, water, energy, waste, climate change and enforcement issues before client, industry and professional audiences.
He is a member of the Colorado, Alaska, California, and American Bar Associations.
COMMUNITY SERVICE
Mr. Volmert co-chairs the Disability Task Force of the Colorado Lawyers Committee, advocating to preserve legal rights and benefits for disabled persons. He also has worked on foster care issues for the Lawyers Committee, and served on the Colorado Bar Association Committee on the Availability of Legal Services. From 1996 to 2005, he served on the Board of Platte River Industries, a non-profit organization that assists disabled persons, as well as providing pro bono legal services for the organization. From 1994-95 he chaired the Manual High School Collaborative Decision Making Committee. Recently he joined the Governing Board of the Regional Institute for Health and Environmental Leadership.
