Mr. Ferguson has been Holland & Hart's principal liaison to the Aspen Skiing Company for the past 25 years. Work for this client has given him a unique command of the legal and practical issues presented by a destination ski resort, including overseeing and performing legal work on behalf of this client in the areas of water rights, wetlands, Section 404 matters, annexations, easements, base area development, race contracts, sponsorship contracts, television agreements, FIS and USSA agreements, trademarks, professional racer agreements, ticket disclaimers, marketing plan review, advertising agency contracts, merchandising contracts, lift agreements, construction and facilities maintenance agreements, maintenance equipment purchase agreements, race releases, environmental issues, rental contracts, restaurant lease agreements, labor relations, tax benefits, and ad valorem tax matters.
He has led a team responsible for developing a diverse resume of preventative legal measures, including risk management and new employee training in the fundamental requirements of the Colorado Ski Safety Act.
Mr. Ferguson is special counsel to the Colorado Ski Country U.S.A., and has worked on behalf of the National Ski Areas Association and the Rocky Mountain Lift Association.
