In V Bar Ranch, LLC v. Cotton, the Colorado Supreme Court held that the State Engineer had jurisdiction to consider a petition to modify a previously-issued well permit for an artesian well in the confined aquifer in the San Luis Valley, but did not have authority to issue a well permit that expanded the beneficial use of the original appropriation.
