Advanced Notice Of EPA's Proposed Rulemaking Defining "Waters Of The United States"

On January 15, 2003, the EPA published an advanced notice of proposed rulemaking (“ANPRM”) in the Federal Register (68 Fed. Reg. 1991), seeking early comments on issues associated with the scope of waters that are subject to the Clean Water Act, in light of the Supreme Court’s decision in Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers, 531 U.S. 159 (2001). The ANPRM especially requests comments on the definition of “waters of the United States.”

Comments regarding the ANPRM must be submitted to EPA by March 3, 2003, and may be submitted by hand delivery or mail, in either written form (4 copies required) or on a CD-ROM, to Water Docket, Environmental Protection Agency, Mailcode 4101T, 1200 Pennsylvania Avenue N.W., Washington, D.C. 20460, Attention Docket ID No. OW-2002-0050.
